How the 2010 and 2011 Changes to the Standard of Need Affect the 185% Rule

Chapter 57 of the Laws of 2009 amended Social Services Law 131-a(2) to increase the basic allowance portion of the public assistance grant over the course of three years. The first increase was on July 1, 2009, and the second increase was on July 1, 2010. The grant increase has implications for working families because it changes the calculation of the 185% rule, which provides an eligibility cut off for families with earnings and other income when their gross income exceeds 185% of the public assistance standard of need. These charts show the public assistance grant levels for 2010 and 2011, the 2010 poverty level, and 185% of the standard of need for 2010 and 2011 for a family of three in every county in New York State.
