SSA is extending the expiration dates of the following body systems in the Listing of Impairments (listings) in its regulations:
Growth Impairment, Musculoskeletal System, Respiratory System, Cardiovascular System, Digestive System, Hematological Disorders, Skin Disorders, Neurological, and Mental Disorders. 77 Fed. Reg. 35264 (June 13, 2012). http://www.gpo.gov/fdsys/pkg/FR-2012-06-13/html/2012-14407.htm.
SSA is not making any other revisions to these body system listings in this final rule, which was effective on June 13, 2012.
SSA cautions that it intends to update the nine listings affected by this rule as quickly as possible, but may not be able to publish final rules revising these listings by the current expiration dates. Hence the two-year extension of the expiration dates. Note that SSA’s inability to meet its deadlines for listing revisions was criticized by the Government Accountability Office (GAO) in its report on SSA’s Modernization Programs. The report was summarized in the discussed in the last edition of this newsletter. http://www.empirejustice.org/issue-areas/disability-benefits/misc-ssi-ssd-issues/reports/gao-issues-preliminary-report.html.
