We hear and see much in the press these days about the burgeoning disability roles, and indeed the number of applicants and recipients has increased in recent years. Social Security, however, is still maintaining its role as gatekeeper.
In Fiscal Year 2011, of the 3,295,806 disability claims filed, only 34% of disability claims were allowed at the initial level. Fifty-eight percent of the 662,765 decisions rendered at the ALJ level were allowances, 13% dismissals, and 29% denials. The Appeals Council magnanimously allowed a whopping 2% of the 103,681 appeals it decided, dismissed 3%, remanded 21%, and denied 74%. Of the 13,271 decisions issued by the federal courts, only 3% were allowed, 9% were dismissed, 46 % remanded and 42% denied.
