Governor Signs Legislation that Repeals Child Support Cooperation Requirements for Child Care Assistance

August 13, 2009

Author: Kristin Brown Lilley

Empire Justice and child care advocates from across the state worked hard to support this bill, which has now become law.  The new law removes what had been a substantial barrier to child care assistance, causing custodial parents to miss work, or even avoid applying for assistance. The statute now makes it clear that applicants may not be required to obtain orders of child support to receive a child care subsidy, while at the same time encouraging applicants to seek child support to bring more resources into the home. Empire Justice gives kudos to Senator Velmanette Montgomery Assemblymember William Scarborough for shepherding this bill through both houses of the legislature and our sincere appreciation to Governor Paterson for signing it into law (chapter 233 of the Laws of 2009).  The law became effective immediately.

If you find that your county did not begin implementing the repeal of this requirement after July 23rd 2009, please contact Susan Antos.
