G. The Low-Income Housing Tax Credit Developments.

In particular, note Chapter 26 describing “Tenant Protections,” and Chapters 13 regarding the owner’s obligation to make units available to the general public and to comply with the Fair Housing Act.  Also, for further authority regarding the “good cause” requirement for lease terminations and non-renewals see chapter 16 which describes in more detail the requirements that must be included in the “Extended Use Agreement” at pp.16-1 and 16-2, and also describes the obligation not to refuse admission to an applicant because of that person’s status as a Section 8 Voucher holder, as required by statute, 26 USC 42(h)(6)(B)(iv).  In addition, an Exhibit to Chapter 13 includes the 2000 Memorandum of Understanding Among the Department of Treasury, the Department of Housing and Urban Development, and the Department of Justice (pp. 13-7 to 13-10) which further describes Section 8 and fair housing compliance and enforcement requirements.
